The Workers' Rights (Working from Home) Regulations 2020 and the Finance (Miscellaneous Provisions) Act 2024 together create binding obligations for any employer who uses or permits WFH in Mauritius.
An employer may require a worker to work from home — but only with at least 48 hours' written notice to the worker. This rule applies when the employer imposes WFH; a worker's own request is at the employer's discretion.
A Work From Home Agreement in the prescribed form must also be signed. It is supplemental to the employment contract — it does not replace it.
Exception: during extreme weather, the employer may require WFH with no notice if there is no risk to life, injury, property damage, or loss of electricity or communications — but the worker receives 2× their normal hourly rate.
Every worker now has the right to disconnect from work and work-related communications during unsocial hours, defined as:
→ Between 1 p.m. Saturday and 6 a.m. Monday
→ Between 10 p.m. and 6 a.m. on any weekday
Exceptions: genuine emergencies, or where the worker's hours correspond to those of an overseas market being served (e.g. BPO/ITO operations).
If a worker is required to work during unsocial hours, they are entitled to a disturbance allowance equal to their hourly wage for each hour worked during those hours, in addition to their normal pay.
This is a statutory entitlement — it cannot be contracted away, waived by agreement, or offset against other allowances. Any clause that removes it is unenforceable.
Tip: review your employment contracts now. Many pre-2024 contracts do not account for this obligation.
